Schott, Bublitz & Engel, s.c. has a statewide school law practice that includes representing students and their parents in special education matters, disciplinary proceedings and general school law issues. Our attorneys assist clients in a variety of ways, from providing consultation to litigating cases in administrative proceedings and state and federal court. For example, our attorneys provide the following services:

  • Active participation in the Individualized Education Program (IEP) meetings, advocating appropriate and effective IEPs

  • Assistance with Open Enrollment issues

  • Communication with school district administration and their attorneys

  • Protection of student rights under Section 504 of the Rehabilitation Act

  • Protection of student rights under No Child Left Behind

  • Referral to experts able to provide independent educational evaluations(IEE)

  • Representation at mediation

  • Representation at due process hearings

  • Representation in state and federal court

  • Representation at disciplinary proceedings, such as
    manifestation determinations and expulsion hearings

Our attorneys have successfully resolved cases throughout the State of Wisconsin involving a broad range of issues, including eligibility to receive special education, provision of a free appropriate public education (FAPE), placement in the least restrictive environment, utilization of Functional Behavioral Analysis and Behavior Intervention Plans, reimbursement for private educational placements, and provision of appropriate services by properly trained personnel.

We have also been able to prevent students from being expelled by proving that the students were eligible to receive special education services and that the students' misconduct was a manifestation of their disabilities. Few people realize that the rules governing expulsions provide more protection for children with disabilities.

Our attorneys have assisted students who face a variety of issues including:

  • Anxiety Disorder
  • Asperger’s Disorder
  • Attention Deficit Disorder (ADD)
  • Attention Deficit Hyperactivity Disorder (ADHD)
  • Autism Spectrum Disorder
  • Bipolar Disorder
  • Chronic Fatigue Syndrome
  • Cognitive Disability (CD)
  • Depression
  • Dyslexia
  • Emotional Behavior Disability (EBD)
  • Hearing Impairment
  • Obsessive Compulsive Disorder (OCD)
  • Oppositional Defiant Disorder (ODD)
  • Other Health Impairment (OHI)
  • Pervasive Development Disorder (PDD)
  • Reactive Attachment Disorder (RAD)
  • Specific Learning Disability (SLD)
  • Speech or Language Impairment
  • Tourette’s Syndrome

Additionally, our attorneys recognize that school districts may involve law enforcement officials when dealing with disciplinary cases. Accordingly, school disciplinary matters often cross over into juvenile court proceedings. Our office represents students in juvenile, criminal and municipal law matters.
